It's not fake I think it has some sort of copy protection, though I'm not sure.
All I know from looking at the code it's expecting two jpegs in the C drive.

The game probally doesn't work unless properly installed.

I'd say it's just the loader and the remaining files are simply missing.
I have an older version of that game and it has no copy protection at all but consists of several
files.
