Is this from a YouTube vid or something? If not, I feel the author should've gone outside the
borders as well.

It doesn't look like it's from a youtube video, the quality is too high. I agree that they should
have gone out of the borders but from my experience in flash, it is a pain to know what goes
where and even more to make the background animated because of different screen sizes. The
background is different for everybody.
