>phone scam
Sorry, these aren't real. FCC regulations make prank calls illegal. Any radio show that says they
are doing a "phone scam" has to get releases prior to conducting them, which ruin the whole idea
behind crank calls.

Seinfeld isn't real either, it's a TV show with actors. I thought it was funny until I heard the
news. The more you know.

"The Commission's rule regarding broadcast of telephone conversations is set forth at Section
73.1206 of the Commission's rules, 47 C.F.R. § 73.1206. Pursuant to this rule, before recording a
telephone conversation for broadcast, or broadcasting such a conversation simultaneously with its
occurrence, a licensee shall inform any party to the call of the licensee's intention to
broadcast the conversation, except where such party is aware, or may be presumed to be aware from
the circumstances of the conversation that it is being or likely will be broadcast. Such
awareness is presumed to exist only when the other party to the call is associated with the
station (such as an employee or part-time reporter), or where the other party originates the call
and it is obvious that it is in connection with a program in which the station customarily
broadcasts telephone conversations."

Basically, the person on the phone must agree that their conversation will be recorded for the
purposes of broadcast every time they answer the phone, it can not be done via a third party
(other family member).

Don't get me wrong, there were parts I thought were funny, but I don't like the fact they're
trying to play it off as a legitimate phone scam. If they were legitimately pranking people, they
would be getting fined out the ass.
The content isn't the problem, it's how they're presenting it. They know it wouldn't be nearly as
funny if they said "it's not a real call", so they fake the whole thing, and people believe that
it's real.

Actually the law is that only one party must know that the call is being recorded.

It could be, but would posting on /f/ be considered broadcasting?
If the flash was actually a radio show, then I could see broadcasting rules applying.

No, but you can't broadcast on radio without a license, and the legislation for that license
usually includes some censorship body. Not 100% sure about America but I imagine that's how you
guys work.

You can record with the consent of one party, but to broadcast you need both parties consent.
They usually get the people they've cranked to allow the broadcast. That's why they call back and
reveal who they are.
