I wonder if they really could. I mean, the bigger problem is that none of the people who made
this are left at Gainax, but if they wanted to make some sort of Gainax reunion Bluray with the
DAICON shorts on it...
I wonder who own's ELO's music these days. If it were up to the artists, I bet they could be
convinced to license it out if they could be made to understand how important the DAICON shorts
are to so many people (in the sense that anime is important to so many people, and that this
short is essentially the collective grandparent of all the anime to come in the next decades).

I can't believe that is really an issue. I know that's what it says on Wikipedia, but countless
other anime since then have featured "bunny girl" costumes without legal repercussions. Besides,
literally every single frame of the shorts contains dozens of parodies and references to not only
popular anime of its day, but also to tons of western media franchises. The "Bunny suit" is far
from the most "blatant" reference.
But parody is allowed anyway. You are allowed to incorporate other people's trademarks in
incidental roles for the sake of parody, that's fair use.
Like for instance, if it only included a short sample of the ELO song instead of the whole thing,
they wouldn't need anyone's permission to show it and even sell it (and there are even some
precedents confirming exactly what counts as a "short" sample).
